1. Acceptance of Terms

By accessing or using the website, mobile application, or services of KweGo Financial Technology Limited (“KweGo”, “we”, “us”, or “our”), you agree to be bound by these Terms of Use and our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree, you must not use our services.

2. Eligibility

You must:

  • Be at least 18 years old
  • Have legal capacity to enter into a binding agreement
  • Use KweGo services in compliance with applicable laws and regulations

3. Nature of Services

KweGo is a financial technology company, not a bank. We provide technology-enabled access to cross-border payments, foreign exchange, and money transfer services through licensed and regulated third-party banks and payment service providers.

KweGo does not:

  • Accept deposits
  • Provide loans or credit
  • Offer investment, legal, or tax advice

4. Account Registration & Data Accuracy

You agree to:

  • Provide accurate, complete, and up-to-date information
  • Maintain the confidentiality of your credentials
  • Notify us immediately of unauthorized access or security concerns

You acknowledge that the collection, verification, and processing of your personal data for account creation and ongoing monitoring is governed by our Privacy Policy.

5. Compliance, AML/CTF & Monitoring

To meet legal and regulatory obligations, KweGo conducts:

  • Customer due diligence (KYC/KYB)
  • Transaction monitoring
  • Sanctions and PEP screening
  • Enhanced Due Diligence where required

You acknowledge and agree that:

  • Transactions may be delayed, restricted, declined, frozen, or reported where legally required
  • Such processing of personal data is carried out in accordance with our Privacy Policy and applicable AML/CTF laws

6. Fees, FX Rates & Disclosures

Applicable fees, charges, and exchange rates are disclosed prior to transaction confirmation. FX rates may include spreads or margins and may vary based on market conditions, liquidity, and transaction characteristics.

Details on how transactional and pricing data is processed and retained are described in our Privacy Policy.

7. Transaction Processing

Transaction processing times are estimates and depend on:

  • Compliance checks
  • Partner bank or PSP processing
  • Cut-off times and settlement windows

KweGo does not guarantee instant or same-day settlement.

8. Suspension & Termination

We may suspend or terminate access where required by law, regulation, security, or risk considerations.

Personal data associated with suspended or terminated accounts will be retained or deleted in accordance with our Privacy Policy and legal retention obligations.

9. Intellectual Property

All software, trademarks, content, and materials are owned by KweGo or its licensors and may not be used without prior written permission.

10. Disclaimer of Warranties

Services are provided “as is” and “as available.” We do not warrant uninterrupted, error-free, or delay-free service.

11. Limitation of Liability

To the maximum extent permitted by law, KweGo shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.

12. Indemnification

You agree to indemnify and hold KweGo harmless from claims arising out of:

  • Your misuse of services
  • Breach of these Terms
  • Violation of applicable laws

13. Dispute Resolution, Arbitration & Small-Claims Carve-Out

13.1 Informal Resolution First

Before initiating arbitration or legal proceedings, you agree to contact KweGo to attempt informal resolution.

We will attempt to resolve disputes within 30 days.

13.2 Binding Arbitration

Except where prohibited by law, any dispute arising out of or relating to these Terms or KweGo services shall be resolved exclusively through final and binding arbitration.

13.3 Arbitration Rules, Seat & Language

  • Arbitration body: LCIA, ICC, or another internationally recognized body
  • Seat: London, England
  • Language: English
  • Arbitrator: Single neutral arbitrator

13.4 Class Action Waiver

All disputes must be brought on an individual basis only. You waive any right to participate in class, collective, or representative actions, where permitted by law.

13.5 Small-Claims Court Carve-Out

A claim may be brought in small-claims court only if:

  • It qualifies under applicable small-claims procedures
  • It is brought on an individual basis only
  • It does not involve Pricing & FX Claims
  • It does not exceed the applicable cap:
  • UK: £5,000
  • EU: €5,000
  • Canada: CAD 10,000
  • United States: USD 5,000
  • Nigeria: ₦2,000,000

13.6 Exclusion of Pricing & FX Claims

All Pricing & FX Claims are excluded from small-claims court and must be resolved through arbitration.

13.7 Currency Conversion

Claim values shall be converted using the official exchange rate in effect on the date the claim is filed.

13.8 Regulatory & Injunctive Rights

Nothing in this section limits your right to contact regulators or KweGo’s right to seek injunctive relief.

13.9 Governing Law

These Terms are governed by the laws applicable to the relevant KweGo entity providing the service, subject to mandatory consumer protections.

14. Privacy & Data Protection

Your use of KweGo services is subject to our Privacy Policy, which explains how personal data is collected, used, shared, retained, and your rights.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of services constitutes acceptance of the updated Terms.
